1. Who we are
Fleur de Fungi, ABN 27 297 255 863, operates fleurdefungi.com.au and related services (the "Services"), which are hosted by Shopify. This policy explains how we collect, use and disclose your personal information. We take privacy seriously and aim to handle personal information consistently with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

2. Your agreement
By using the Services, placing an order, or giving us your information, you acknowledge that you have read this policy and consent to your personal information being handled as described in it. If you do not agree, please do not use the Services.

3. What we collect

  • Contact details: name, email, billing and shipping address, and phone number if you provide one at checkout.
  • Order details: items you view, add to your cart, buy or cancel, and payment confirmation. Card payments are processed by Shopify's payment providers and we do not store your full card number.
  • Account details, if you create an account.
  • Communications: enquiries and messages you send us.
  • Email and marketing activity: whether you open or click our emails, and which products you browse or buy, so we can send relevant messages.
  • Device and usage information: IP address, browser, device, pages viewed and how you reached our site, collected through cookies and similar technologies.

We do not ask for health information. Please do not include it in messages or order notes.

4. How we collect it
Directly from you, automatically when you use our website, and from service providers who work on our behalf, such as Shopify, payment processors and couriers.

5. How we use it

  • To provide the Services: process payments, pack and ship orders, handle cancellations and claims, and respond to your questions.
  • Marketing: to send newsletters and promotions by email where you have signed up or as the law permits, and to show you ads on other platforms. You can unsubscribe from emails at any time using the link in each message.
  • Security and fraud prevention.
  • To understand and improve our website, products and services.
  • To meet legal obligations and respond to lawful requests.

6. Cookies, advertising and analytics
We use cookies and similar technologies, including:

  • Meta Pixel and Conversions API, which share information about your visits and purchases with Meta so we can measure and personalise our advertising on Facebook and Instagram.
  • Google Analytics, which helps us understand how visitors use our website.
  • Google Merchant Center and the Google & YouTube app for Shopify, which list our products on Google.
  • Klaviyo, which we use to manage our email marketing and track how people interact with our emails and website.

These providers collect and handle information under their own privacy policies, and we are not responsible for their practices. You can limit tracking through your browser settings and through the ad preferences in your Meta and Google accounts. You can opt out of Google Analytics using Google's browser add-on.

7. Who we share it with
Shopify and payment providers; couriers such as Australia Post, to deliver your order; Klaviyo, for email marketing; Meta and Google, as described above; accounting and bookkeeping providers; and professional advisers, regulators or law enforcement where the law requires. We do not sell your personal information.

8. Overseas disclosure
Some of our service providers, including Shopify, Klaviyo, Meta and Google, store or process information outside Australia, including in Canada and the United States. We take reasonable steps to choose providers with appropriate privacy and security practices. By using the Services, you consent to this disclosure.

9. Security and data breaches
We take reasonable steps to protect personal information from misuse, loss and unauthorised access, including relying on the security features of Shopify and our other providers. No system is completely secure, and information sent over the internet may not be secure in transit, so please avoid sending sensitive information by unsecured channels. If a data breach occurs that is likely to cause serious harm, we will notify affected people and the OAIC as the law requires.

10. Retention
We keep personal information for as long as we need it to provide the Services and to meet tax, accounting and other legal requirements, then destroy or de-identify it.

11. Accuracy and your responsibilities
Please make sure the information you give us is accurate and up to date. If you create an account, keep your login details private. You are responsible for activity under your account unless you tell us it has been compromised.

12. Access, correction and complaints
You can ask to access or correct the personal information we hold about you, or ask us to delete it where the law allows. Email hello@fleurdefungi.com.au and we will respond within a reasonable time. We may need to confirm your identity first, and we may decline a request where the law permits, for example where it is unreasonable or we must keep the records. If you are not satisfied with how we have handled a request or complaint, you can contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.

13. Children
The Services are not directed at children, and we do not knowingly collect personal information from them. If you think a child has given us their information, contact us and we will delete it.

14. Third-party links
Our website and emails may link to other sites. We are not responsible for their privacy practices, so please read their policies.

15. Limits of this policy
Nothing in this policy limits any rights you have under Australian law that cannot be excluded. Subject to those rights and to the extent the law allows, we are not liable for loss arising from the actions of third-party providers, or from events outside our reasonable control.

16. Changes
We may update this policy from time to time. The latest version will be posted here with a new date, and continued use of the Services means you accept the updated policy.
